Business Law Essay Consideration is an essential element of a valid contract. The four main ingredient of a contract is the offer, the acceptance, the consideration and the intention to create legal relation. Consideration refers to what one party to an agreement is giving or promising in exchange for what is being given or promised by the other contracting party. There are certain rules that govern a valid contract.The issue in the case is whether the agreement was legally binding upon Dream Design or whether it failed for want of consideration. If the promise merely fulfils an existing contractual duty to the promisor, he does not provide consideration to buy the buy promisor’s promise. The baskets were to be delivered by A and a rate was agreed upon between the party. After the first delivery A demanded more money from K before making any further deliveries to W. K unwillingly agreed to pay the extra money and A continued with the delivery. Later on K refused to pay the extra money to A and A sued K. It was held that A had not given consideration to K to buy K’s promise of extra money. A could not say that making the delivery was the consideration, as A was contractually bound to make these deliveries under the original contract. With the case of Dream Design the consideration will not be sufficient where a contractually duty already exist. The fact is that Parma Steel and Dream Design agreed on a written contract dated October 22, 2009 for the supply of fabricated steel at a cost of $165 per ton for â€Å"Grade60,000 and $156 per ton for â€Å"Hard Grade. † In this case Parma Steel could not say that making the deliveries was the consideration, as Parma Steel was already contractually bound to make these deliveries under t he original contract. According to Tucker J. there was no consideration for the new agreement. The plaintiff was already obliged to deliver the defendant goods at the rates agreed under the terms of the original agreement. The facts constituted economic duress but the court has to refuse to enforce the new agreement for the increase in the prices or the higher charges as it lacked any fresh consideration from the purchaser, Dream Design. The supplier, Parma Steel claim for the outstanding balance has to be dismissed.

Valenzuela 1 Daniel Valenzuela Professor Fairweather December 15, 2013 Philosophy 101 Value and Meaning Nozick’s has a couple ways in defining value and meaning while both are somewhat similar to each other. By defining value, Nozick introduces intrinsic value which states that other kinds of value exist by their relation (Nozick, pg 162). Also, while defining value, there are a couple of different specific characteristics, such as, organic unity, which means ‘unity in diversity’. Nozick defines meaning by stating that meaning cannot be gained with something that is completely worthless (Nozick, pg 167). By having value and meaning accustomed in my life, I can see my growth and development along with having special value with health, family, and friendship. I could make drastic changes in my life to make it more meaningful and to have a much better value. While having a better value and meaningful life, this shows how much happier I can be along my life. Nozick states that when something has intrinsic value, its organic Valenzuela 2 unity is its value (Nozick, pg 164). There can be many different specific characteristics in describing value, but the one that really does is organic unity, this shows a major dimension that controls most of the value. Also, according to Nozick, â€Å"...a resultant organic unity depends upon two things, the degree of diversity and the degree of unity to which that diversity is brought† (pg 164). With this said, the different varieties of diversity, the harder it is to bring unity. Also, in order to have a special value in our lives and activities that we cherish, we want the highest degree of organic unity. By describing this, Nozick states, â€Å"We want to encompass a diversity of traits and phenomen... ...myself to receive a better outcome. Now, knowing that in order to be successful and achieve happiness, you’re going to have some road bumps and sometimes even fail. However, it’s not about failing, its about how you bounce back to see if you could achieve it again or come back stronger. By having this asset, this teaches me the value and meaning of life. In conclusion, Nozick defines value with organic unity and then states that meaning is the grand scheme of things. Arguments and explanations that Nozick interprets that shows the definition of meaning and value actually makes a lot of sense due to the analogies being used and the understandable way he writes it. The Relationship between amount of sleep and reaction time

In addition, there have been many catastrophic events in the world caused by lack of sleep or fatigue in certain situations. These include the disaster of Coherency, the Challenger explosion In 1986 and the Exxon Valued oil spill, many claim, were caused by lack of sleep and fatigue. The employees at Coherency were overworked, working 13 hours or more. The pilots of the Challenger had a significant lack of sleep and the oil spill caused by the workers working over 22 hours per day. Furthermore, these catastrophic events are all that could be affected or prevented with a quick reaction time.Therefore, could the fatigue and lack of sleep have led to slower reaction times causing these events to occur or was it another variable that the fatigue caused? I wonder if there is a relationship between amount of sleep and reaction time. Plan: To find out the relationship between amount of sleep and reaction time, if there is one, I will be using two different type of investigation. Firstly, I will be doing some of the investigation myself by taking a sample from my year group and having them complete a test.In addition to that, I will also be getting results from other studies, Investigations and reports on the same experiment as the results would be more reliable and varied. For my own Investigation, since I am comparing, It Is difficult to have certain independent or dependent variables. However, since I am seeing how amount of sleep affects reaction time, as my independent variable, I will use the amount of sleep measured in hours and I will be using the reaction time measured in seconds. I will obtain the amount of sleep by asking the people within the sample and I will get the reaction time by having the sample take a free online test.For this investigation, I will be using convenience sampling since the investigation has a very small time limit and I will not have any resources available to investigate on a larger sample or to do sample which is outside of this sam ple. Therefore these results are quite unreliable since It Is only done on a very small group and It Is only convenience sampling so It only takes Into account a very small group of people in a certain location. This Is why I will also be using other Investigations, papers and studies to get more reliable and accurate information.I will have a sample of 15 people from etc. To find more reliable, accurate and more varied data. Once I have collected the results, I will firstly create a table out of the raw information to simply take down the results. Then, I will create a processed data able to make it easier to create graphs. Then I will work out averages for the reaction times and amount of sleep making them into box and whisker plots. Then, I will create a scatter graph to compare both my variables. I believe that the results will be that the amount of sleep has a very large influence over one's reaction time.This selection was purely reliability and credibility of the source as th e 2 most credible and reliable sources were chosen for the data and information. The first source was the paper â€Å"Effect of Total Sleep Deprivation on Reaction Time and Waking EGG Activity in Man† by the American Sleep Disorders Association and Sleep Research Society, written by l. Lorenz, J. Ramose, C. Race, M. A. Guava and M. Coors-Caber. The second paper was by Mitch Leslie for the Stanford report with the name â€Å"Sleep impacts reaction time as much as alcohol. Both of these sources gave information such as averages, graphs and conclusions with some analysis but did not give the raw data. Therefore, some of this processed data could be misleading and could be biased. In addition, the data that these sources give are quite different compared to the data given from my investigations. This would mean that my results are probably unreliable as it was conducted on a very small group, none of the variables were changed so there was not much variety and the results were m ostly inaccurate.In addition, there are some missing values especially for the time some people went to the estimated hours of sleep they had gotten. I will treat this as all the other values although if they seem like outliers on a graph, it would be because they are inaccurate. To analyses, I will group the data and information by source treating them differently. Overall, I believe that I have enough data to analyses and to create a inclusion since I have the data I have collected and the information from the other studies.
